As a general principle, the Unamacor Group will scrupulously comply with legislation on the protection of personal data and must be able to demonstrate this (the ‘proactive accountability’ principle), paying particular attention to any processing operations that may pose a higher risk to the rights of data subjects (the ‘risk-based approach’ principle).
In light of the above, GRUPO UNAMACOR SL will ensure compliance with the following principles:
- Lawfulness, fairness, transparency and purpose limitation. Data processing must always be communicated to the data subject, through clauses and other procedures; and shall only be considered lawful if consent to the processing of data has been given (with particular attention to consent provided by minors), or if there is another valid legal basis and the purpose of the processing complies with the Regulations.
- Data minimisation. The data processed must be adequate, relevant and limited to what is necessary in relation to the purposes of the processing.
- Accuracy. Data must be accurate and, where necessary, kept up to date. In this regard, the necessary measures shall be taken to ensure that personal data which is inaccurate in relation to the purposes of the processing is erased or rectified without delay.
- Limitation of retention period. Data shall be retained in a form which permits identification of data subjects for no longer than is necessary for the purposes of the processing.
- Integrity and Confidentiality. Data shall be processed in such a way as to ensure the appropriate security of personal data, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage, through the application of appropriate technical or organisational measures.
- Data transfers. The purchase or acquisition of personal data from unlawful sources is prohibited, as is the processing of such data where it has been collected or transferred in contravention of the law or where its lawful origin cannot be sufficiently guaranteed.
- Engagement of suppliers with access to data. Only suppliers offering sufficient guarantees to implement appropriate technical and security measures in the processing of data shall be selected for engagement. A formal agreement to this effect shall be documented with these third parties.
- International data transfers. Any processing of personal data subject to European Union regulations that involves a transfer of data outside the European Economic Area must be carried out in strict compliance with the requirements set out in the applicable law
- Rights of data subjects. The Unamacor Group shall facilitate data subjects’ exercise of their rights of access, rectification, erasure, restriction of processing, objection and data portability, establishing internal procedures for this purpose, and in particular the necessary and appropriate forms for exercising these rights, which must, at a minimum, satisfy the applicable legal requirements in each case.
The Unamacor Group shall ensure that the principles set out in this Personal Data Protection Policy are taken into account (i) in the design and implementation of all work procedures, (ii) in the products and services offered; (iii) in all contracts and obligations entered into or undertaken; and (iv) in the implementation of any systems and platforms that allow access by employees or third parties and/or the collection or processing of personal data.
